THIS PRIVACY POLICY DOES NOT REQUIRE ANY PHYSICAL, ELECTRONIC OR DIGITAL SIGNATURE.

THIS PRIVACY POLICY IS PUBLISHED AND SHALL BE CONSTRUED IN ACCORDANCE WITH THE PROVISIONS OF THE INFORMATION TECHNOLOGY (REASONABLE SECURITY PRACTICES AND PROCEDURES AND SENSITIVE PERSONAL DATA OF INFORMATION) RULES, 2011 FRAMED UNDER INFORMATION TECHNOLOGY ACT, 2000; THAT REQUIRES PUBLISHING OF THE PRIVACY POLICY FOR COLLECTION, USE, STORAGE AND TRANSFER OF SENSITIVE PERSONAL DATA OR INFORMATION.

Thank you for using the products and services offered by MUKESH CHHABRA CASTING COMPANY (“we”, “us” or “our”)! We value the trust you place in us.

We are committed to protecting your privacy. This Privacy Policy explains how we collect, use and share your personal information. This Privacy Policy applies to your use of the software, applications, products and services offered by us (which includes our stores, apps, digital contents etc.) (“our products and/or services”) as further described in our Terms of Use available at https://www.mccc.in/.

By using our products or availing our services, you agree to be bound by the terms and conditions of this Privacy Policy. You hereby expressly consent to the processing of your personal information and non-personal information in accordance with this Privacy Policy. Your information may be stored, processed or transmitted in India or any other part of the world, where laws regarding storing, processing or transmitting of personal information may be less restrictive than the laws in your country. You always have the option to not provide or withdraw information by choosing appropriate options/choices available in the privacy section of our products and services; however, please note that by virtue of you not providing a particular information or withdrawing any information, we shall be entitled to discontinue your use of a particular service or feature on our products and services.

By mere use of or access to our products and/or services, you expressly consent to our use and disclosure of your personal and other information in accordance with this Privacy Policy; however, without prejudice to above, you will be required to confirm and provide your consent over an email that you agree to the terms of this Privacy Policy and have no objection to the use of the information and data provided by you. This Privacy Policy is incorporated into and is subject to the Terms of Use by reference. You herby expressly grant your written consent to us through the app to collect, possess, receive, upload, store, deal with, handle and/or use, share, disclose and transfer the personal information and/or sensitive personal data to such persons and such lawful purposes as contained in this Privacy Policy. Please note that our products and services are offered in and are being operated from the Republic of India. In the event you are located in any place other than in the Republic of India, you shall not be eligible to avail the services/products offered by us.

I. APPLICABILITY OF PRIVACY POLICY
This Privacy Policy shall be applicable only to the use and disclosure of information on the app. This Privacy Policy does not apply to information collected by or through any other medium, collected offline or by any other person and/or entity other than the app or any other whose link might be present on the app for example, if you click on a link of another displayed on the app, it may direct you to the other website in which case this Privacy Policy shall not be applicable.

II. USER INFORMATION

We may collect several types of information about its users. Some of this information may be given voluntarily by the user while availing certain services offered on the app; while some information may be collected automatically when the user is surfing the app.
Information provided voluntarily –
It may be noted that the we may require you to voluntarily provide information about yourself in the following events:

1. When you register yourself with the app
2. When you fill out a form/ application to avail any of the services provided by us on the app
3. When you communicate with us or make a request on the app; via e-mail, phone or SMS.
4. When you participate in blogs, chats, forums or write testimonials on the app.

In any of the aforesaid events, you may be required to provide the following information (a) Your name;(b) Contact details including postal address, pin code, email address, phone number, residency status; (c) Identity proofs (e.g. driving license, passport, PAN card, birth certificate, etc.); (d) Personal details such as age, sexual orientation, marital status, occupation, interests and hobbies etc;(e) Details of your talent, skill, hobbies;(f) Work experience; (g) Ethnicity.(h) Language; (i) Dialect; (j) Weight; (k) Height; (l) Eye colour;(m) Chest; (n) Waist; (o) Hair length; (p) Hair type; (q) Hair colour; (r) Skin colour etc.

III. ELIGIBILITY, USE AND INFORMATION
You are eligible to register and avail the services provided on the app only if you are an Eligible Person. In case the services offered by the and app are for and on behalf of a minor or a child artist or a person who is not an Eligible Person, the and app must be accessed by only the parents/ legal guardians who have to be competent to contract and act on behalf of such minor or child artist or person who is not an eligible person. Such parents/ legal guardians will be responsible adhering to this privacy policy and for the actions of the minor, child artist or a person not being an Eligible Person, on whose behalf he/she accesses the app without any liability whatsoever on us.

IV. TYPES OF INFORMATION WE COLLECT

We collect personal, sensitive and other information from you in a variety of ways when you use our products and/or services, such as:

1. Account: We collect, and associate with your account information like your name, your company’s name (if applicable), birth date, email address, phone number, profile details, photographs, occupation, income level, interests and hobbies, gender, sexual orientation, medical history, allergies, existing medical ailments and conditions, marital status, address, identity proofs and other personally identifiable information. If you create an account by logging in with your credentials from your third party account with certain social networking sites (such as Twitter, LinkedIn, Google+ or Facebook), we may receive information about you from such social networking sites, in accordance with the terms of use and privacy policy of that social networking site. We work with such social networking site’s application protocol interface (API) in a way that allows you to authorize us to access your account on that social networking site on your behalf. If you consent to our sharing of your information with these social networking sites (e.g., post public content on your wall/profile page), we will share your information with them in accordance with your privacy choices. Once we share your information with these social networking sites, the terms and policies of these sites, and not our Privacy Policy, will apply to their use of your information. We encourage you to read individual terms of use and privacy policy of each of these s before using them and/or disclosing your personal information.
2. Background and History: We collect personal and medical records and history from you or from publicly available sources. We may also have arrangements with other services providers such as hospitals, clinics, medical stores, medical camp organizers who may already have your medical information. You hereby authorize each of such services providers to share your information with us. Please note that we shall use such information only for the purposes specified in this Privacy Policy.
3. Billing, Collection and Payment Information: When you make a payment through our products or services, your payment card information is processed by our third party processors (“TPPs”) and payment service providers (“PSPs”) who may record and collect your payment card information necessary to process your payment. Our products and service may retain and store your payment card information, if opted or instructed by you. The information that will be stored includes your payment card type and the last four digits of the payment card. You will be provided an option to remove your stored payment card information through your account settings page.
4. Products’ and/or Services’ Use Related: When you use our products and/or services, we store, process and transmit your files (like images, videos, emails, feedback, postings, comments, log file information from browser, software etc., metadata and other data) and information related to them. If you give us access to your contacts, we’ll store those contacts on our servers for you to use. This will make it easy for you to do things like share your data, send emails, and invite others to use our products and/or services.
5. Surveys: We may occasionally ask you to complete optional online surveys. These surveys may ask you for contact information, geographic information, and demographic information (like postal codes, age, or income level, lifestyle etc.). We use this data to tailor your experience at our products and services, providing you with content that we think you might be interested in and to display content according to your preferences.
6. Usage: We collect information about your profile, behavior, choices, medical history, allergies, medical conditions, and preferences as per the data input by you. Your devices (depending on their settings) may also transmit location information to us. Our products also provide information to us about its status, such as uptime, available memory, and errors that may have occurred.

Analytic Services: We may use third party analytics services such as Google Analytics, KISSmetrics and Comscore, to collect information about how you use and interact with our products and/or services. Such third-party analytics services may use cookies to gather information such as the pages you visited, your IP address, a date/time stamp of your visit and which site referred you to our products and/or services. We use these analytics services to help us analyze how people use our products and services, to improve them, to customize the content/features users see/use based upon their interests and to send email/reminders/followups to users who are not actively using our products or services. 10. Information Collected from Third Parties: We may receive information about you from third parties that offer their products and/or services on our products and/or services. 11. Other Information: We may also collect other sensitive personal data or information as included in Rule 3 of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.

Please note that information about you shall not be considered to be sensitive or personal or private, if it is freely available in the public domain or under right to information laws or under any other applicable law for the time being in force.

V. HOW WE USE YOUR INFORMATION
1. For Appointment and Reminders: We may use the contact details provided by you to send appointment details and reminders thereto. Please note that if any information provided by you is wrong or incorrect or incomplete then in that case, we will not be responsible for the information loss or privacy loss due to the message going to an another destination.
2. For Other Offerings: We may use and share information to inform you about different types of roles and alternatives available to you or our other products and services and improvements/enhancements thereto.
3. For Research: We may use and share your information for research purposes on anonymous basis without expressly identifying you in any way.
4. For Operations: In general, the information you submit to us is used either to respond to requests that you make, or to aid us in serving you better. We may also use your information in the following ways:
(a) to send you a welcome e-mail and to verify ownership of the e-mail address provided when your user account was created;
(b) to identify you as a user in our system;
(c) to provide access to our products and provide services to you;
(d) to facilitate the creation of and secure your user account;
(e) to provide improved administration of our services;
(f) to notify you about updates to our products and/or services;
(g) to improve and customize the quality of experience when you interact with our products and/or services;
(h) to third party contractors/service providers that provide services to on our products and services;
(i) to permit third parties who may need to contact users who have bought products/services;
(j) to send you administrative e-mail notifications, such as security or support and maintenance advices;
(k) to engage with or contact inactive users of our products and/or services;

(o) to complete payment transactions as instructed by you;

(s) to analyze the performance of our personnel and the quality of services performed. In addition to the above, if you are a service provider, then:
(a) to list or add new products or services offered by you; and
(b) to pass on the customer/clients request for appointments/visits/consultations;

5. General: We may also use and share aggregated or de-identified information for any purpose and in any manner. This anonymous data we share may include non-personally identifiable data that we create using your personal information by excluding information that makes the data personally identifiable.

VI. CONTENT POSTED ON THE APPLICATION
1. You understand and agree that the app may delete any listing, content, communication, photos or profiles that in our sole discretion violates this agreement or which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of either us and/or our users.
2. With respect to content submitted or made available for inclusion on publicly accessible areas of the application including but not limited to your contact details, you hereby unconditionally and irrevocably grant us the consent and license to use, store, distribute, reproduce, prepare derivative works of, modify, adapt, publicly perform and publicly display such content on the application and to the members from time to time.
3. We do not control the content posted via the service and, as such, does not guarantee the accuracy, integrity or quality of such content. We advise all user/s to independently verify the content /information posted by the other members before acting upon the same and under no circumstances will we be liable in any way for any content, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted or otherwise made available via the service.
4. We reserve the right to verify the authenticity of content posted on the website. In exercising this right, we may ask you to provide any documentary or other form of evidence supporting the content you post on the website.
5. You must use the services in a manner consistent with any and all applicable rules, regulations and laws of India.

VII. HOW WE SHARE YOUR INFORMATION
We may share information as per terms of this Privacy Policy, however we shall endeavor that such use of information does not create hindrance on your use of our products and services. We do not share your personal information with third parties other than as follows:
1. Internally: We may share your information with our retainers, agents, contractors or third party service providers who provide administrative, telecommunications, computer, financial intermediary, payment or securities clearing or other services to us in connection with our products and services or the operation of our business.

4. Your representatives: Unless you specify otherwise, we may share your information with your family member or friend or other representative who helps with your medical care.

We may do this to inform your family about your location and condition when required. If you do not want us to share information as above, you will have to unselect the option available in the privacy settings. Please note that we may share your information with authorities to prevent a serious threat to your or others’ health and safety.

Generally, with your consent: Any information or content that you voluntarily disclose for posting to our products and/or services and becomes available to the public, as controlled by any applicable privacy settings that you set. To change your privacy settings on our products and/or services, you may change your profile settings. Once you have shared the content/data with any person or made it public, that content/data may be re-shared by others.

1. Security: We have a team dedicated to keeping your information secure and testing for vulnerabilities. We also continue to work on features to keep your information safe in addition to things like alerts when new devices and apps are linked to your account.
2. Retention: We will retain your personal information for as long as we need it to provide you the services or to retain back-up/archives.
3. No warranty: We use commercially reasonable safeguards to help keep the information collected through our products and/or services secure and take reasonable steps (such as requesting a unique password) to verify your identity before granting you access to your account, however, we cannot ensure or guarantee the security of any information you transmit to us or guarantee that information on our products and/or services may not be accessed, disclosed, altered, or destroyed by any person.
4. Around the world: To provide you with our products and/or services, we may store, process and transmit information in locations around the world - including those outside your country. Information may also be stored locally on the devices you use to access our products and/or services. By registering for and using our products and/or services, you consent to the transfer of information to any part of the world in which we, our affiliates or service providers maintain facilities and the use and disclosure of information about you thereto as described in this Privacy Policy.

IX. GENERAL TERMS IN RESPECT OF INFORMATION

As per our Terms of Use, our products and services shall not be used by persons who are incompetent to contract as determined under the applicable laws. If we become aware that our products and services are used by such a person, we may delete such information from our files and deactivate the related account. Further, in any event, we shall not be held responsible for any such information and/or its nonavailability.

If any personal information or sensitive personal data or information provided by you is found to be inaccurate or deficient, then the same shall be immediately corrected or amended by you. To attain this end, you may be granted reasonable access to such information or you may request us to update your information by emailing the request/clarification at info@mccc.in. We may however before processing such requests, ask you to identify yourself and the information/data requested to be modified by you in order to avoid repetitive and/or illegitimate requests. We shall not be responsible for any delay in updating such information. Please note that we will not be responsible for the authenticity of the personal information or sensitive personal data or information supplied by you.

You have a right to ask us in writing for limiting whom we share your information with. Although we are not obliged to grant your request, we will endeavor to fulfill it, unless such information is needed in emergency situation.

We may withhold or may not be able to provide information to you for valid reasons including if it:

a) contains references to another user(s);

b) is subject to legal/ contractual privilege or cannot be disclosed for other legal reasons;

c) contains our or other users’ confidential commercial/ business information;

d) is not maintained by us;

e) was created in the course of a dispute resolution process;

f) could threaten the life or security of another individual/ entity;

g) was disclosed under a court order or was disclosed to a government institution as part of an investigation.

Our products and services may contain message/bulletin boards, chat rooms, or other message or communication facilities (each a “Forum”). Any information you reveal in a Forum, including but not limited to any public forum is not subject to this Privacy Policy and can be seen by third parties. It is therefore important that you carefully consider what information you disclose in such a Forum. Any information that may be revealed in such a Forum shall not be considered to be sensitive personal information.

You are responsible for maintaining the secrecy of your unique password and account information, and for controlling access to emails between you and us, at all times. We are not responsible for any third party functionality, privacy or security policies which you are bound by. We will endeavor to block your account or provide restricted access upon being informed of such an event in order to protect your identity and information. However, we shall not be responsible for any unauthorized use/access to your account or disclosure of any personal information by virtue of such an event.

The uploading, dealing, handling and/or using of any information for any lawful purpose by us, including for the purposes and in the manner outlined above shall not constitute ‘publication’ in any manner.

X. CHANGES TO THE PRIVACY POLICY
We may change this Privacy Policy from time to time. If we make any changes to this Privacy Policy, the last modified Privacy Policy shall be applicable to you.

XI. COMMUNICATIONS
We may periodically send you free newsletters and promotional communications. When you receive newsletters or promotional communicationsfrom us, you may “opt-out” of these emails by following the unsubscribe instructions provided in the email you receive or by contacting us at info@mccc.in.
